Welcome to the PG Search website, located at https://pgsearch.ae (the "Site"), and operated by PG Search LLC ("PG Search", "Company", "we" or "us"). The following terms and conditions (the "Terms") govern your access to, and use of, all or part of the Site and any content, materials, or features made available on or through the Site (collectively, the "Services").

By accessing, viewing, downloading or otherwise using the Site or the Services, you certify that you have read, understand, and agree to be legally bound, both on your behalf and on behalf of the organisation you represent (collectively, "you"), by these Terms and our Privacy Notice, which is incorporated into these Terms by reference as if fully set forth herein. You represent and warrant that you have the authority to use the Site in accordance with these Terms and, to the extent you act on behalf of an organisation, to bind that organisation to these Terms. You further certify that you have reached the age of majority in the jurisdiction where you reside, or are older, or that you have the permission of a legal guardian (for example, a parent) to use the Site. If you do not agree to these Terms, you are not granted permission to use the Site and must discontinue use immediately.

PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND RESPONSIBILITIES, INCLUDING A DISPUTE RESOLUTION CLAUSE AND A CLASS ACTION WAIVER.

1. Licence to Use the Site

Subject to these Terms, Company grants you a personal, limited, terminable, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Site solely for lawful purposes and in accordance with these Terms. You are responsible, at your sole expense, for procuring, operating, and maintaining the computer system, mobile device, hardware, software, and other items necessary or appropriate to enable you to use the Site.

2. General Restrictions on Use

You agree to use the Site and the Services only for purposes permitted by these Terms, and in compliance with all applicable laws, regulations, and generally accepted practices and guidelines in the relevant jurisdictions.

You will not (and will not attempt to):

  • (a) access the Site by any means other than through interfaces provided by Company;
  • (b) gain unauthorised access to Company systems or engage in any activity that interferes with performance of, or impairs the functionality or security of, the Site or Company networks and systems;
  • (c) access the Site through any automated means or with any automated features or devices (including scripts, web crawlers, data mining, scraping, robots, spiders, or other data gathering or extraction tools), except to the extent the Site is indexed by general purpose consumer-accessible search engines;
  • (d) access or collect personal data or other information about individuals for any purpose, including commercial purposes;
  • (e) reproduce, duplicate, copy, sell, trade, or resell any aspect of the Site or Site Content for any purpose;
  • (f) upload, post, or otherwise transmit through the Site any unsolicited or unauthorised advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, phishing, or any other form of solicitation;
  • (g) stalk, harass, or otherwise disturb another person;
  • (h) impersonate another person or misrepresent your identity or affiliation; or
  • (i) infringe any intellectual property rights, privacy rights, confidentiality obligations, or other rights of any person or entity.

Company may suspend, restrict, or terminate access to the Site (in whole or in part) at any time, with or without notice, including where Company reasonably believes you have breached these Terms, or for security, operational, or legal reasons.

3. Intellectual Property; Site Content

As between you and Company, Company owns all right, title and interest in and to the Site, the Services, and all content and materials made available on or through the Site, including text, graphics, logos, icons, images, layout, design, and compilations of data, and any related intellectual property rights (collectively, "Site Content").

All Site Content is protected pursuant to copyright, trademark, and other applicable laws. You must not remove or alter any copyright notice or other proprietary notice on the Site or any Site Content. Under no circumstances will you have any rights of any kind in or to the Site Content, other than the right to use the Site Content in accordance with these Terms.

4. User Submissions (including Candidate Information)

Certain features of the Site may allow you to submit information or materials to Company (for example, contact details, CVs, biographies, role enquiries, or other content) (collectively, "User Content"). By submitting User Content, you represent and warrant that:

  • (a) you have the full legal right and authority to provide the User Content;
  • (b) the User Content is accurate to the best of your knowledge; and
  • (c) Company's use of the User Content as contemplated by the Site and these Terms will not infringe any third-party rights or violate any law or agreement, including through failure to obtain required consents for personal data.

If you provide third-party personal data (for example, a referee's details), you represent and warrant that you have obtained the necessary permissions and have a lawful basis to share it.

You grant Company a worldwide, royalty-free, irrevocable, transferable licence to access, use, reproduce, display, modify, translate, create derivative works based upon, and distribute User Content, in each case to the extent reasonably necessary to:

  • (i) operate the Site and provide the Services,
  • (ii) respond to your enquiries,
  • (iii) conduct executive search and leadership advisory processes (as applicable),
  • (iv) comply with legal obligations, and
  • (v) enforce these Terms.

Company is under no obligation to maintain any User Content in confidence, except as set out in the Privacy Notice or a separate written agreement. Company expressly reserves the right to remove any User Content for any reason or for no reason.

5. Executive Search Context; No Guarantee of Outcomes

The Site is provided for general information about Company and its services. Unless Company expressly states otherwise in writing, the Site does not create a client relationship, advisory relationship, or recruitment relationship.

Submitting information through the Site does not guarantee an interview, a role, inclusion in any process, or ongoing consideration.

Some mandates and processes may be confidential. Company may limit what it can disclose about a role, a client, or process status, and may communicate only on a need-to-know basis.

6. Errors, Inaccuracies, and Omissions

Occasionally there may be information on the Site that contains typographical errors, inaccuracies, or omissions. Company reserves the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

7. Monitoring and Enforcement; Termination

Company has the right to take appropriate legal action for any illegal or unauthorised use of the Site, and to cooperate with law enforcement authorities or court orders requesting or directing Company to disclose the identity or other information of anyone providing information on or through the Site.

8. Links to and Features Provided by Third Parties

The Site may contain links or references to third-party websites or services for convenience. Company does not control third-party sites and expressly disclaims any responsibility for third-party content, accuracy, availability, policies, or practices. Your use of any third-party websites or services is at your own risk and subject to the relevant third party's terms and conditions.

9. Service Access

Company endeavours to ensure that the Site is normally available, but Company does not guarantee uninterrupted availability. Access to the Site may be suspended temporarily and without notice in case of system failure, maintenance, repair, security incidents, or for reasons beyond Company's control.

10. Disclaimers and Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES THAT:

  • (A) THE SITE, SITE CONTENT, OR SERVICES WILL MEET YOUR REQUIREMENTS;
  • (B) THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
  • (C) DEFECTS WILL BE CORRECTED; OR
  • (D) ANY CONTENT, SERVICES, ADVICE, INFORMATION, OR LINKS PROVIDED BY THIRD PARTIES OR USERS ARE ACCURATE, COMPLETE, OR RELIABLE.

YOUR USE OF THE SITE IS AT YOUR OWN RISK. THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMPANY (AND ITS PARTNERS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SUPPLIERS) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMPANY'S TOTAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SITE OR SERVICES WILL BE LIMITED TO THE MINIMUM AMOUNT PERMITTED BY APPLICABLE LAW.

IF YOU ARE DISSATISFIED WITH THE SITE, SERVICES, OR THESE TERMS, YOUR SOLE REMEDY IS TO DISCONTINUE USING THE SITE.

12. Indemnity

You agree to defend, indemnify, and hold harmless Company, its affiliates, officers, directors, employees, agents, licensors, and suppliers, from and against all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • (a) your use of and access to the Site and Services;
  • (b) your violation of these Terms, including the Privacy Notice;
  • (c) your fraud, violation of law, negligence, or wilful misconduct;
  • (d) your violation of any third-party rights, including intellectual property or privacy rights; or
  • (e) your submission of User Content.

This obligation survives termination of these Terms.

13. Compliance with Legal and Regulatory Requirements

You represent and warrant that you will comply with all applicable legal and regulatory requirements in connection with your use of the Site and Services, including anti-bribery, anti-corruption, and anti-money laundering laws and regulations, and applicable international trade and sanctions requirements to the extent relevant.

14. Dispute Resolution; Arbitration; Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Services that cannot be resolved informally shall, to the maximum extent permitted by applicable law, be finally resolved by binding arbitration.

Unless Company elects otherwise, arbitration shall be administered by the Dubai International Arbitration Centre (DIAC) in accordance with its rules in force when the arbitration is commenced. The seat of arbitration shall be Dubai, United Arab Emirates. The arbitration shall be conducted in English before one arbitrator, unless applicable rules require otherwise.

You and Company agree that any proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action, to the maximum extent permitted by applicable law.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights.

15. Governing Law and Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Dubai.

Subject to Section 14, the courts of Dubai, United Arab Emirates shall have jurisdiction.

16. Changes to these Terms

Company may update these Terms from time to time by publishing an updated version on the Site. Your continued use of the Site after changes are published constitutes acceptance of the updated Terms. You can determine when these Terms were last revised by checking the "" date at the top.

17. Miscellaneous

(a) Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

(b) No waiver: No failure or delay by Company to exercise any right or remedy will operate as a waiver of that right or remedy.

(c) Assignment: You may not assign or transfer these Terms or any rights or obligations under them without Company's prior written consent. Company may assign these Terms without restriction.

(d) Entire agreement: These Terms, together with the Privacy Notice, constitute the entire agreement between you and Company relating to your use of the Site.

(e) Headings: Headings are for convenience only and do not affect interpretation.
